An Alabama online notary is a remote service provided by a certified notary public appointed to handle the witnessing of legal documents. To verify a signer, the notary will request the online identification of the individual, which must be government issued.
Is Online Notary Legal in Alabama?
Yes, under Senate Bill SB275, which went into effect on July 1, 2021, and codified into the statutes under § 36-20-73.1.
Online Notary Requirements
It allows online notary services to take place under the following conditions:
- Two (2) forms of government-issued identification, one (1) that must include a photo of the signatory (and a description must be made on how it was verified);
- Two (2)-way audio and video communication;
- Date and time of the notarial act;
- A description of the documents;
- The notary public must be physically located in Alabama; and
- The video recording of the signatory must be held for a period of seven (7) years.
